Terms and Conditions of Hire
Please read our Terms and Conditions as you will be asked to confirm that you have read and understood these before your booking can be confirmed.
Each booking requires a signed rental agreement which will be sent in advance of the booking. By signing the rental agreement the Hirer acknowledges the terms and conditions of the Agreement and agrees to pay for the hire charges and for any late, lost, stolen, broken, non-returned equipment, and for all other amounts payable under the terms and conditions of this Agreement. Please see terms and conditions below for further details.
SPECIFIC TERMS & CONDITIONS FOR ONLINE BOOKING
1.1 – “Equipment” shall mean the iPad or other items, services or accessories being hired.
1.2 – “First Hire Day” and “Last Hire Day” shall mean the first and last days respectively on which the Equipment is being hired by you.
1.3 – “Hire Period” shall mean the period during which the Equipment is being hired and will commence on the First Hire Day and terminate on the Last Hire Day.
1.4 – Hirer shall mean the person in whose name the equipment is rented.
This agreement is entered into between iPadhire Ireland and Hirer.
3. BOOKING CONSTRAINTS
3.1 – Booking Date:-iPadhire Ireland can accept bookings with at least 3 days advance notice and up to 12 months in advance
3.2 – Minimum hire duration: -The minimum Hire Period is 1 day and hires of less than 24 hours will be charged a full day’s rate.
3.3 – Subject to Availability: iPadhire Ireland will make all reasonable efforts to provide you with the Equipment you order. However, please note that due to unknown factors such as Equipment not being returned on time, insufficient lead time, lost or stolen Equipment, etc., all of our Equipment is subject to availability. If the Equipment you desire is unavailable, we will try to replace it with Equipment of the same standard that is capable of fulfilling the same purpose.
4. DELIVERY AND COLLECTION
4.1 – Pick-up and Return of Equipment: Equipment shall be delivered on the First Hire Day and shall be returned on the Last Hire Day at the agreed location.
4.2 – Identification. Personal renters must hold and produce a valid passport where the delivery of the equipment takes place and this will be recorded. You may also be required to make a deposit of up to €400 for each ipad rented.
5. DUTIES OF EACH PARTY
5.1 Duties of iPadhire Ireland
i. Deliver the Equipment on the First Hire Day, subject to clause 3.3.
ii. Ensure that the Equipment is suitable for the purpose intended.
5.2 Hirer’s duties
i. Pay the price referred to in Clause 6.
ii. Not to use the Equipment imprudently.
iii. Allow iPadhire Ireland to examine the Equipment at any time.
iv. Allow any urgent repairs to the Equipment.
v. Inform iPadhire Ireland immediately if there is any fault or defect.
vi. Return the Equipment in its initial condition on the Last Hire Day.
5.3 – Repossession of Equipment: iPadhire Ireland reserves the right to request the return of the Equipment or to repossess the Equipment if you do not comply with your duties as above, or if the Equipment appears to be abandoned. In the event of repossession, iPadhire Ireland reserves the right to charge the Hirer for the full Hire Period or for any period thereof.
6.1 – All prices shall be as listed on the website or as quoted and are subject to change without notice. The prices are guaranteed for the hire associated with a confirmed booking. The prices take into account all mandatory charges and include Value Added Tax.
6.2 – Additional charges may be levied in the following situations:
i. Damages & Theft: Up to the limit of the Equipment’s manufacturer’s suggested retail price for the same or equivalent item of equipment.
ii. Failure to Return the Equipment: Failure to return the Equipment for any reason on the Last Hire Day or when requested to do so by iPadhire Ireland, will result in our charging you the full amount of the manufacturer’s suggested retail price for the Equipment, in addition to any charges for the Hire Period. See Also 11 below.
7. PAYMENT / CREDIT CARD
We accept Credit Card Payments only on a “card present” basis. Payment can be made by means of cheque made payable to iPadhire Ireland, cash or electronic funds transfer direct to our bank account.
7.1 – iPadhire Ireland will submit an invoice for the amount due for the entire Hire Period when you agree to the booking and by accepting this agreement you hereby agree to pay for all hire charges and for any damage, late, lost, stolen, broken or non-returned equipment in accordance with Clause 6.2 and for all other amounts payable under the present terms and conditions. Unless otherwise agreed, invoices are payable in advance of the Hire Period.
8. CHANGES TO RESERVATION: MODIFICATION / CANCELLATION POLICY
8.1 – Cancellations: You may cancel this agreement at any time by notifying iPadhire Ireland by e-mail of your intention to cancel. Notification can only be accepted by email and quoting the hire reference agreement. Phone cancellations cannot be accepted. In the case of cancellations, the following is our cancellation policy:
A minimum charge of €10 will apply to all cancellations. Cancellations within 28 days from date of pick up will result in a charge of 30% of the value of the booking. For cancellations within 14 days a charge of 50% of the value of the booking will apply. For bookings cancelled within 7 days but more than 48 hours from date of pick up 75% of the value of the booking will apply. No refund will apply to bookings cancelled within 48 hours from date and time of pick up. No refund will apply in the case of data charges.
8.2 – Unused Booking: Equipment that is scheduled to be picked up will be kept for 24 hours and then cancelled (unless rebooked). If the equipment is not picked up, no refund will apply.
8.3 – Changing Bookings and Extension of Hire Period: We will do our best to accommodate any changes that you may wish to make to your booking, including any extensions that you may wish to make to the hire period. Please note, however, that any such changes are subject to availability, particularly when requested within 72 hours or less of your First Hire Day.
9.1 – Nothing in these terms and conditions will affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of iPadhire Ireland. You expressly acknowledge and agree that iPadhire Ireland, its officers, directors, employees will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to: damages for loss of profits, goodwill, use, data or other intangible losses (even if iPadhire Ireland has been advised of the possibility of such damages), resulting from the use of the equipment set out in the rental agreement.
9.2 – These terms and conditions have been issued under Irish law and are accessible on www.ipadhire.ie
9.3 – Neither party shall be liable for failure in its performance hereunder caused by any case of Force Majeure. “Force Majeure” shall be considered as any irresistible or unforeseeable event, independent of the party suffering the case of Force Majeure, which prevents this party from fulfilling its obligations.
9.4 – Any change in this Agreement must be in writing and must be signed by the parties hereto.
9.5 – You do not acquire any ownership or other interest in the Equipment except as specifically set forth herein.
9.6 – This Agreement constitutes the entire agreement between the two parties.
Damage protection is available as an additional option at a cost of Eur 5 per day and covers damage to the screen or case up to Eur100. Where the hirer has taken out damage protection on the equipment the Hirer will remain liable for any excess or for any sums not covered under the damage protection. Damage not covered or failure to return the Equipment for any reason on the Last Hire Day or when requested to do so by iPadhire Ireland will result us charging you for the full amount of the manufacturer’s suggested retail price for the equivalent Equipment, in addition to any charges for the Hire Period.
11 – CHARGE FOR NON-RETURNS
The following charges will apply for the non-return of items at the end of the hire period: – Ipads at replacement cost, charge leads €20, Adapters €20, Packaging / Packing box €15, Carry Bag €15, iPad Cases and Cases Covers €30, locking key for stands €10 and all other items at replacement cost.
